Cancellation/Refund Policy

Cancellations must be made by customers at least 48 hours in advance of their scheduled tour to receive a full refund, minus a $5.00 service fee. EcoTours reserves the right to cancel tours at any time due to weather or other safety reasons. In the event of cancellation by EcoTours, a tour may be rescheduled for an available date or a 50% refund will be made.

No refunds for no-shows.

Eco Tours New Orleans, LLC is not liable to customers, guests, guests’ employees, patrons, and visitors, or to any other person for any damage to person or property. Eco Tours New Orleans, LLC is not liable to customers, guests, guests’ employees, patrons, and visitors, or to any other person for any damage to person or property caused by any act, omission or neglect of the guest or any other tenant of the described premises, and customers and guests agree to hold Eco Tours New Orleans, LLC and its manager harmless from all claims for any damage whether the injury occurs on or off the premises. Eco Tours New Orleans, LLC will not be liable to customers, guests, guests’ employees, patrons and visitors, or to any other person for any injury caused by any defect therein to the customers, guests, guests’ employees, patrons and visitors, or to any other person or anyone on the premises who derives his right to be thereon from the customers, guests, guests’ employees, patrons and visitors, or to any other person.

The Service is controlled, operated and administered by ETN from our offices within the USA. If you access the Service from a location outside the USA, you are responsible for compliance with all local laws. Indemnification

Hold Harmless Agreement

Each undersigned person (the “Undersigned”) does hereby agree to hold harmless, defend and indemnify Thomas A. Carrere, Eco Tours New Orleans, LLC, their agents, contractors and each owner of the Premises and Tour Vessels (the “Indemnitees”) from and against any liability arising from or losses suffered, caused, as a result of or related in any way to tour and hunting activities on the Premises and or Tour Vessels whether arising under theories related to tort or contract or arising by operation of law or whether arising out of neighborhood, strict liability, negligence or latent or patent defects in the lands, waters, equipment, structures or buildings thereon. This indemnity, defense and hold harmless extends to and includes loss or damage to property of the undersigned and to personal illness, personal injury and death from any cause whatsoever to the undersigned or the minor children of the undersigned to the extent the same is related in any way to the Premises or any liability of the Indemnitees is asserted. This indemnity, defense and hold harmless also extends to and includes loss or damage to the Undersigned related in any way to damages caused by the Undersigned to property of third persons and to personal illness, personal injury and death of third persons caused or alleged to be caused by the activities of the Undersigned individually or jointly with any of the Indemnitees. The Undersigned agrees and acknowledges (i) that hunting or other activity on the Premises and or Tour Vessels will be at the sole risk of the Undersigned; (ii) that there exists risk inherent in hunting or other activity including but not limited to wild animals, other hunters, poachers, trespassers, fire, flood, dangerous or defective deer stands or hunting blinds or structures, hiking, traversing, boating, or using other means of transportation to or on the Premises; and (iii) that each and every risk of traveling to or being on the Premises, known and unknown, listed or unlisted, is specifically assumed by the Undersigned. In the event that this agreement exceeds that legally permissible, then this agreement shall be deemed to be restricted to or reduced to the extent that its provisions are permissible under applicable law the parties agreeing that any unenforceable provisions that cannot be revised by the enforcing court will be severed from this agreement and the remaining provisions enforced as written or amended. Any joint negligence of the indemnitees and the undersigned will remain subject to this indemnity and not be subject to any shared risk of loss.

The Undersigned further agrees that any insurance coverages in favor of the Undersigned shall also protect and operate for the benefit of the Indemnitees in the event of any allegations of liability by the Indemnitees to the Undersigned that is not enforceable under this agreement.

Liability disclaimer

THE INFORMATION, SOFTWARE, PRODUCTS, AND SERVICES INCLUDED IN OR AVAILABLE THROUGH THE SITE MAY INCLUDE INACCURACIES OR TYPOGRAPHICAL ERRORS. CHANGES ARE PERIODICALLY ADDED TO THE INFORMATION HEREIN. Eco Tours New Orleans, LLC AND/OR ITS SUPPLIERS MAY MAKE IMPROVEMENTS AND/OR CHANGES IN THE SITE AT ANY TIME.

Eco Tours New Orleans, LLC AND/OR ITS SUPPLIERS MAKE NO REPRESENTATIONS ABOUT THE SUITABILITY, RELIABILITY, AVAILABILITY, TIMELINESS, AND ACCURACY OF THE INFORMATION, SOFTWARE, PRODUCTS, SERVICES AND RELATED GRAPHICS CONTAINED ON THE SITE FOR ANY PURPOSE. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ALL SUCH INFORMATION, SOFTWARE, PRODUCTS, SERVICES AND RELATED GRAPHICS ARE PROVIDED “AS IS” WITHOUT WARRANTY OR CONDITION OF ANY KIND.

Eco Tours New Orleans, LLC AND/OR ITS SUPPLIERS HEREBY DISCLAIM ALL WARRANTIES AND CONDITIONS WITH REGARD TO THIS INFORMATION, SOFTWARE, PRODUCTS, SERVICES AND RELATED GRAPHICS, INCLUDING ALL IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL Eco Tours New Orleans, LLC AND/OR ITS SUPPLIERS BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL DAMAGES OR ANY DAMAGES WHATSOEVER INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF USE, DATA OR PROFITS, ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OR PERFORMANCE OF THE SITE, WITH THE DELAY OR INABILITY TO USE THE SITE OR RELATED SERVICES, THE PROVISION OF OR FAILURE TO PROVIDE SERVICES, OR FOR ANY INFORMATION, SOFTWARE, PRODUCTS, SERVICES AND RELATED GRAPHICS OBTAINED THROUGH THE SITE, OR OTHERWISE ARISING OUT OF THE USE OF THE SITE, WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY OR OTHERWISE, EVEN IF Eco Tours New Orleans, LLC OR ANY OF ITS SUPPLIERS HAS BEEN ADVISED OF THE POSSIBILITY OF DAMAGES. BECAUSE SOME STATES/JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, THE ABOVE LIMITATION MAY NOT APPLY TO YOU. IF YOU ARE DISSATISFIED WITH ANY PORTION OF THE SITE, OR WITH ANY OF THESE TERMS OF USE, YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE USING THE SITE.

Termination/access restriction

ETN reserves the right, in its sole discretion, to terminate your access to the Site and the related services or any portion thereof at any time, without notice. To the maximum extent permitted by law, this agreement is governed by the laws of the State of New Orleans and you hereby consent to the exclusive jurisdiction and venue of courts in New Orleans in all disputes arising out of or relating to the use of the Site. Use of the Site is unauthorized in any jurisdiction that does not give effect to all provisions of these Terms, including, without limitation, this section.

You agree that no joint venture, partnership, employment, or agency relationship exists between you and ETN as a result of this agreement or use of the Site. ETN’s performance of this agreement is subject to existing laws and legal process, and nothing contained in this agreement is in derogation of ETN’s right to comply with governmental, court and law enforcement requests or requirements relating to your use of the Site or information provided to or gathered by ETN with respect to such use. If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect.

Unless otherwise specified herein, this agreement constitutes the entire agreement between the user and ETN with respect to the Site and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between the user and ETN with respect to the Site. A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form. It is the express wish to the parties that this agreement and all related documents be written in English.

Changes to Terms

ETN reserves the right, in its sole discretion, to change the Terms under which Ecotoursneworleans.com is offered. The most current version of the Terms will supersede all previous versions. Swamp Tours

Eco Tours New Orleans is located 22 miles (30 minutes) south of Downtown New Orleans.

Driving Directions:

From Canal Street, take Magazine Street towards I-10 and US-90 BUS W.
Just past the World War II Museum, cross Calliope Street and continue on Magazine Street underneath the overpass and take the immediate onramp to the left onto US-90 BUS W.
Take US-90 BUS W (the Crescent City Connection) over the Mississippi River and continue 7.5 miles until exit 4B, LA 45/Barataria Boulevard, keeping left to avoid earlier exits.
Take Exit 4B, LA 45/Barataria Boulevard, and coming down the offramp, turn left at the light to cross back underneath the expressway onto LA 3134 South (Leo Kerner Lafitte Parkway).
Continue on LA 3134 South for 9.5 miles. At the end of this highway, continue straight to cross over the bayou and double back onto yourself, and after a few hundred feet, come to an intersection with Jean Laffite Blvd/LA-303 (an Exxon station will be right in front of you).
Take a right onto Jean Laffite Blvd/LA-303, and continue one mile before turning right onto Estuary Road. You’ll see the signs for Eco Tours New Orleans at the intersection of Jean Laffite Blvd/LA-303 and Estuary Road.
